These Terms of Service apply to all users who create a Fynd account, including buyers, sellers, or anyone who uses Fynd’s services beyond browsing the public site.
These Terms operate alongside our Terms of Use, Privacy Policy and Cookie Policy. By creating a Fynd account, you agree to all applicable policies.
3. Accepting These Terms
By registering for a Fynd account, you confirm that you have read and agree to these Terms.
If you do not agree, do not create an account or use the associated services.
4. Eligibility
- You must be at least 18 years old.
- The platform is intended for UK residents.
5. Your Fynd Account
- You must provide accurate and complete information.
- You must keep login details confidential.
- You are responsible for all activity on your account.
- You must notify us of any unauthorised access.
- We may refuse or close accounts at our discretion.
6. Your Responsibilities
- Use the platform lawfully and respectfully.
- Do not upload unlawful, misleading, offensive, or harmful content.
- Ensure your property listings and uploads are accurate.
- Do not misuse the platform — including hacking attempts, scraping, impersonation, or fraud.
7. Our Role (We Are Not an Estate Agent)
Fynd is a self-service online marketplace — not an estate agent.
We do not:
- negotiate offers
- verify property details
- conduct valuations or viewings
- prepare contracts
- provide legal or financial advice
Communications and decisions between users are their own responsibility.
8. Listings and User-Generated Content
- Sellers are responsible for listing accuracy.
- Buyers must conduct their own due diligence.
- We may remove content that breaches our Terms.
- Uploaded content may be used in accordance with our Privacy Policy.
9. Our AI Tools
- AI assists with communication, suggestions, and automation.
- AI content may contain errors or omissions.
- AI is not a substitute for professional advice.
- We accept no liability for actions based on AI output.
10. AI-Mediated Communications Between Users
All communication on Fynd is AI-mediated, not direct messaging.
The AI processes, routes, and may draft messages, but users must:
- review AI-drafted text before sending
- not rely solely on the AI for important decisions
- verify key details externally where needed
We do not guarantee delivery times, interpretation accuracy, or message clarity.
We may retain communication records for service improvement and compliance.
11. Fees & Payment Terms (Offer Acceptance Fee)
- Listing and receiving offers is free.
- A £150 Offer Acceptance Fee is charged when a seller accepts their first offer.
- The fee is not dependent on completion.
- The fee allows unlimited future accepts for that listing.
- The fee is non-refundable.
12. Third-Party Providers & Referral Fees
Fynd may display or integrate independent third-party services.
We may receive referral fees, but this does not affect your pricing.
We are not liable for the performance or suitability of third-party services.
13. Suspension or Termination
We may suspend or terminate accounts for breaches, misuse, fraud, or unsafe behaviour.
14. Availability of the Platform
We do not guarantee uninterrupted service. We may modify or discontinue parts of the platform at any time.
15. Limitation of Liability
Except where prohibited by law, liability is limited to £100.
We are not liable for:
- errors in user content or listings
- AI inaccuracies
- communication issues
- third-party services
- lost profits or indirect losses
16. Indemnity
You agree to indemnify Fynd for losses arising from:
- misuse of the platform
- breach of Terms
- your content or actions
17. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
Courts of England and Wales have exclusive jurisdiction, except consumers in Scotland or Northern Ireland, who may bring claims in local courts.
