1. Introduction
These Terms of Use (“Terms”) set out the rules for using our domain, including our website at fynd.properties, as well as any related sub-domains, sibling domains, mobile or tablet versions, and any URL or Application Programming Interface (API) through which Fynd’s data or services can be accessed (collectively referred to as the “Site”).
In these Terms, “we”, “us”, or “our” means The Private Property Portal Ltd, trading as Fynd. References to “you” or “your” mean any person who accesses or uses the Site.
The Fynd platform is a self-service property marketplace built to empower users to list, buy, or sell property privately, without the need for an estate agent. Fynd does not act as an estate agent and is not subject to the provisions of the Estate Agents Act 1979. All terms of business are set out within these Terms, and we are not subject to the Estate Agents (Provision of Information) Regulations 1991.
By accessing or using the Fynd platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Use of the Fynd Platform
By visiting our Site or using the Fynd platform in any way, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Site or any part of the Fynd platform.
You must be at least 18 years old to use the Fynd platform. By accessing or using the Site, you confirm that you meet this requirement.
These Terms form a legally binding agreement between you and us if you use the Fynd platform by creating an account or accessing any of our services. Nothing in these Terms obliges you to open an account, but any use of the platform is governed by them.
These Terms may reference additional documents that apply when using the Fynd platform, including our Terms of Service, Privacy Policy, and Cookie Policy.
3. Changes to our Terms
We may update these Terms from time to time by publishing the revised version on the Site. Each time you use the Site, you should review the Terms to ensure you understand the terms that apply at that moment.
4. Changes to our Site
We may update, change, suspend, or discontinue any part of the Site at any time. This may include changes to content, features, functionality, or your ability to access the Site. We are not obligated to provide notice of such changes.
5. Your obligations and acceptable use
- You are solely responsible for ensuring your device, operating system, browser, and internet connection meet the technical requirements needed to access the Site.
- You must not misuse the Site or our systems. This includes attempting unauthorised access, interfering with the Site, testing vulnerabilities, disrupting operation, or introducing harmful code (viruses, trojans, worms, logic bombs, etc.). You must not misuse or falsify any form or communication submitted through the Site.
- You must not use automated systems (bots, scrapers, crawlers, etc.) to access, extract, copy, or interact with the Site without express written permission.
- You must not upload or submit content that is unlawful, offensive, defamatory, discriminatory, misleading, or inappropriate, or use the Site for spam or unauthorised advertising.
- If you upload content or use interactive features, you must follow the content standards in clause 6. You warrant your content complies; business users indemnify us for breach.
Unless you receive express prior written consent from us, you must not:
- Access the Site to obtain property information except by direct human interaction with human-readable pages through a standard browser or official Fynd app.
- Use technical methods enabling access prohibited above.
- Extract or facilitate extraction of property information, listings, data, or content except through normal human use of navigation, search, and filters.
- Use the Site in a business capacity for market research, competitor intelligence, or analysis of the property market or Fynd users without our consent.
Any permission granted under this clause may be withdrawn at any time without notice.
6. Interactive services and content
- Personal information submitted through enquiry forms or interactive features is processed under our Privacy Policy.
- Interactive forms must be used only for intended purposes; we may withhold delivery if misused.
- Content you upload is treated as non-confidential and non-proprietary unless stated otherwise in our Privacy Policy. We may use, reproduce, distribute it, and disclose your identity if a third party claims infringement.
- The views expressed by users do not represent our views.
Your content must:
- be accurate where you state facts
- be genuinely held where you state opinions
- comply with the laws of your country when uploading
Your content must not:
- include defamatory material
- include obscene, offensive, hateful, discriminatory, unethical, immoral, or inflammatory material
- infringe (or potentially infringe) third-party intellectual property rights

- Some features require a Fynd account. Registration is free and requires you to be 18+. We may refuse applications at our discretion.
- Your registration is personal; do not share login details.
- Choose a unique password and do not reuse passwords from other services.
- Provide accurate, complete, up-to-date information.
- You are responsible for all activity on your account and must report suspected breaches immediately.
- We may disable or close accounts if these Terms are breached or your account poses a risk.
8. Intellectual property
- All intellectual property on the Site (database rights, text, graphics, logos, images, code, design elements, etc.) belongs to us or our licensors.
- Consumers may download content for personal use only where enabled; no copying/modifying/distribution without consent.
- Business users must not copy, republish, store, extract, or link to Site material without consent.
- Fynd trademarks and brand assets are protected; do not use or imitate without consent.
9. Warranty
- We do not guarantee downloads are virus-free.
- We do not guarantee uninterrupted, secure, or error-free access; we may change the Site without notice.
- Site information is general interest only and not advice; we do not guarantee accuracy or completeness.
- We do not warrant property information is correct or up to date; it is user/partner provided.
- We do not warrant compliance with laws outside the UK.
- We exclude implied warranties/terms to the fullest extent permitted by law.
- Fynd is not an estate agent and does not verify property details. You rely on property information at your own risk and should verify directly with the listing user.
10. Artificial Intelligence Services and Limitations
- AI tools assist with enquiries, communication, drafting messages, and automation, but may be inaccurate or incomplete.
- AI outputs are informational only and not legal, financial, or property advice.
- You must verify AI-provided information independently and not rely on it for buying/selling decisions.
- We do not guarantee AI accuracy and accept no liability for loss or misunderstanding from its use.
- AI interactions are automated and may contain errors or limitations.
11. Not an Estate Agent
- Fynd is a self-service marketplace and not an estate agent under the Estate Agents Act 1979.
- We do not negotiate, arrange, or manage property sales; all decisions remain between buyer and seller.
- Listings are created by users; we do not verify or endorse property details.
12. Third-Party Services and Referral Fees
Fynd may display or offer access to independent third-party providers, such as:
- conveyancers and solicitors
- mortgage brokers
- property photographers
- floor plan and EPC providers
- removal and storage companies
- tradespeople and home services
- Third parties are not employed, controlled, or endorsed by Fynd.
- We may receive referral fees or commission when you use third-party links or integrations.
- Referral fees do not increase your price, do not obligate use, and do not affect display order.
- You may request details of referral fees via info@fynd.properties.
- We are not responsible for third-party performance; contracts are between you and the provider.
13. General Provisions
- Entire Agreement: These Terms replace all prior agreements about Site use.
- Severability: If a clause is invalid, the rest remain in effect.
- No Waiver: Failure to enforce a right is not a waiver unless in writing.
- Assignment: You may not transfer rights without consent; we may transfer ours.
- Relationship: No partnership, employment, or agency is created.
- Third-Party Rights: No rights arise under the Contracts (Rights of Third Parties) Act 1999.
14. Limitation of Liability
Nothing excludes liability for death/personal injury, fraud, or anything not excludable under UK law.
To the fullest extent permitted by law, we are not liable for losses arising from:

- AI-generated content or automated messages
- interruptions or failures of the Site
- viruses or malware
- third-party services or referrals
- actions of other users
- missed communications, failed offers, disputes
- lost income/profit/savings, reputational damage, goodwill loss
We are not an estate agent and do not oversee transactions. Subject to clause 14.1, total liability is limited to £100.
15. Indemnity
You agree to indemnify and hold us harmless for claims arising from:
- breach of these Terms
- your use or misuse of the Site
- content you upload
- your interactions with other users
- reliance on property information or AI outputs
- third-party claims related to your Site use
Business user indemnity applies in full; consumer indemnity applies as permitted by law.
16. Governing Law and Jurisdiction
- These Terms are governed by the laws of the United Kingdom.
- Courts of England and Wales have exclusive jurisdiction.
- Consumers in Scotland or Northern Ireland may bring claims in local courts.
